We are proud to announce the issuance of a decisive positive ruling by the Supreme Administrative Court, touching upon the operation of the largest waste packaging management system, on a case handled by our office. The Council of State annulled regulatory decisions of the municipal authority operating the landfill site in Attika, imposing excessive waste disposal charges to recycling sorting operators which, if upheld, could jeopardize the sustainability and continued operation of the entire packaging recycling system in the largest region of the country. The recently issued ruling by the Supreme Administrative Court will result in the write-off of municipal charges totaling 9m€ approx. for all businesses concerned. This decision also further strengthens the recent trend of the Council of State’s case law to the effect that invalid regulatory administrative acts which are also found illegal in substance, are annulled on both grounds for reasons of legal certainty. In this case, the invalid act is explicitly annulled on grounds of substance rather than on formal grounds to prevent the administration from re-issuing the same illegal act without formal irregularities.
